Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Petory mobile application and petory.app website (the "Service"), operated by MWH Studios ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian.

2. Accounts

To access certain features, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with reasonable prior notice where possible.

3. Description of the Service

Petory is a pet care companion application that helps you manage your pet's daily routines, health records, walks, and more. The Service is provided on a local-first basis — your data is stored primarily on your device.

4. Free and Premium Tiers

Free Tier: You may use Petory for one pet with full features, forever. No trial period, no credit card required, no expiration. All core features — routines, health tracking, walk logging, and more — are available at no cost.

Premium Tier: A paid subscription that unlocks:

• Multiple pet profiles
• Cloud sync across devices
• Family sharing and collaboration with caregivers

We reserve the right to modify the features included in each tier. If we remove a feature from the Free Tier that you actively use, we will provide at least 30 days' notice.

5. Subscriptions and Payments

Premium subscriptions are billed through the Apple App Store or Google Play Store ("Platform"). By subscribing, you agree to the following:

• Payment is charged to your Platform account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription through your Platform's subscription settings
• Refunds are handled according to the refund policies of the respective Platform

Prices may change with reasonable notice. Price changes will not affect your current billing period.

6. Your Content and Data

You retain all ownership rights to the data you enter into Petory, including pet profiles, health records, notes, photos, and walk logs ("Your Content"). We do not claim ownership of Your Content.

As a Premium user, you grant us a limited license to store, process, and transmit Your Content solely for the purpose of providing the Service to you, including cloud sync across your devices. This license terminates when you delete your account or Your Content.

You are responsible for maintaining backups of Your Content. While we take reasonable precautions to protect cloud-synced data, we are not liable for data loss.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or disassemble the application
• Interfere with or disrupt the Service or its servers and networks
• Attempt to gain unauthorized access to other users' accounts or data
• Use automated systems (bots, scrapers) to access the Service without permission
• Upload malicious content, viruses, or harmful code
• Impersonate another person or entity

8. Intellectual Property

The Service, including its design, code, graphics, logos, and trademarks, is owned by MWH Studios and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

"Petory" and the Petory logo are trademarks of MWH Studios. You may not use these marks without our prior written permission.

9. Third-Party Services

The Service may integrate with third-party services (e.g., Apple HealthKit, Google Fit, map providers). Your use of such services is governed by their respective terms. We are not responsible for the availability, accuracy, or practices of third-party services.

10. Disclaimers

Not Veterinary Advice: Petory is a pet care management tool, not a substitute for professional veterinary advice, diagnosis, or treatment. Always consult a qualified veterinarian for your pet's health concerns. We are not responsible for any decisions made based on information tracked or displayed in the app.

"As Is" Basis: The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by applicable law, MWH Studios and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, profits, or goodwill
• Service interruptions
• Unauthorized access to or alteration of your data
• Any pet health outcomes related to use of the Service

Our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty euros (€50), whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless MWH Studios from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, with notice where practicable.

Upon termination:

• Your right to use the Service ceases immediately
• Locally stored data remains on your device until you delete the app
• Cloud-synced data will be deleted within 30 days, unless retention is required by law
• Active subscriptions should be cancelled through your Platform to avoid further charges

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we will provide additional notice through the app or email.

Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which MWH Studios is established, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through the competent courts of the jurisdiction in which MWH Studios is established.

Nothing in these Terms affects your statutory rights as a consumer under applicable local law.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MWH Studios regarding the Service, superseding any prior agreements.
